Hi,

Theoretically, yes, as you are not modifying any of the original software
but replacing it.  Doubtless if there are any conditions of the original
sale that specify you cannot modify the device, than you would be violating
those, but then again that condition is so open that even using the phone
normally could be considered as a violation.

The firmware updates are legally available, as are the tools used for
flahsing.  I guess only if the OP was doing something that avoided making
any required payment, then it would be OK.
