- Unlicensed operation in the TV broadcast bands - The 38-page Notice of 
Proposed Rulemaking has been released by the Federal Communications 
Commission (FCC). It's interesting reading, with many safeguards 
proposed (including the need for an unlicensed transmitter to receive a 
control signal from a broadcaster before being allowed to transmit in an 
adjacent channel and possible GPS location identification for fixed 
transmitters) and certain channels (2-4, 14-20, 37, and 52-69) 
considered off-limits for different reasons. It also addresses the issue 
of interference to wireless mics:

- Unavailability of HD TiVo - It still seems to be an issue, based on 
correspondence I've received.

- AVC licensing - MPEG LA has come out with what they call their final 
terms (that would be in addition to the Via Licensing terms, which 
represent different patents). Not being a lawyer and not having seen the 
actual license agreement, I hesitate to comment, but it looks workable 
to me based on the press release. Here are some tidbits:
- The term "free television AVC video" now has a broader definition.
- The "one-time fee option" offered to Japanese broadcasters now appears 
to apply to all broadcasters, but I'm not sure whether "one-time" means 
once or once-per-license-term.
- The first term runs through 2010. Renewable five-year terms will 
follow with increases limited to 10% per renewal:

- The 10-channel UK pay-TV DTT service Top-Up TV claimed 20,000 
subscribers in its first month (considerably more than either USDTV or 
Voom). They say their break-even is 250,000 and believe there are

- Some 160,000 DTT receivers have been sold since January in Italy, 
where prices are said to be among the highest in Europe (220 Euros/$266 
at today's conversion rate), second only to Spain (229 Euros). Those in 
the UK average 128 Euros, but the article says those in Germany are 207 
Euros, whereas the next item says they're just 80:

- The latest list of DTT receivers in Australia has 33, of which only 
five can handle HDTV. The least-expensive HD model is A$699 (US$494); 
the least expensive SDTV model is A$199 (US$141):

- DTT in Germany this week expanded to Bonn, Bremen, Cologne, and 
Hanover. Set-top boxes are said to cost 80 Euros ($97):

- Those wonderful spell-checkers department: Euros are indicated by a 
symbol that looks like a majuscule C with an equals-sign through it, 
thus ¬ (for those of you with appropriate software). Screen Digest's 
E-Cinema Alert #132 notes that the HDTV satellite service Euro1080 
appears as a price of 1080 Euros even on the organization's own web 
site! It looks fine to me, so maybe it was the observer's software:

- Based on figures from CEA, sales of VCRs to U.S. dealers were down 
68.3% for the first 18 weeks of 2004 compared to the same period in 
2003, and, for the first time factory sales of TV/DVD combos exceeded 
those of TV/VCR combos). Non-H/DTV direct-view TV sets were UP 1.8%. My 
ten-week running average for them was down 6.6% (it was a rough week).
So-called "Digital Television" sales to U.S. dealers for the 18th week 
were 53,259 units. For the first 18 weeks of the year, there were 
1,337,669 units. "Digital Televisions" (most of which are HDTV displays 
without DTT-reception capability) accounted for about 14.8% of the TVs 
(not counting plasma or direct-view LCD) sold to U.S. dealers so far 
this year. It may be worth noting here what that means. Over 85% of the 
non-plasma, non-direct-view-LCD TVs sold so far this year were still 
plain non-H/DTV direct-view TVs with picture tubes.
To qualify as a "Digital Television," a display need only be capable of 
dealing with at least 480p; it need not be capable of either receiving 
digital signals or displaying them. Devices actually capable of 
receiving DTT signals were still a small fraction of those numbers.
I am not permitted to release the week-19 figures until June 1, so I'll 
delay next week's memo.

- NPD has a new report, "Taking Stock: The Consumer Perspective on 
Television Ownership," based on a sample of 7630 adults surveyed between 
March 15 and 25. Among the findings are these:
- Projection TVs represent 9% of those being sold to consumers, LCDs 6% 
and plasmas 1%.
- For projection TVs, there is 6% penetration for those earning under 
$50,000 per year, 19% above $100,000/year.
- 27% of LCDs are 24-to-29-inch, 26% 40-to-49-inch:

- Ads for set-top DTT receivers: I saw none this week.

- The ads - Best Buy was offering a portable DVD/LCD combo (Mintek 
MDP-5860) with the purchase of any "digital TV $1499.99 & up" and a 
handheld LCD TV (Casio TV-980) with the purchase of an TV $599.99 to 
$1499.98. Circuit City has gone back to seeming to call all LCD TVs 
"digital."
If the "Major Brand Name" at Fry's in Dallas is the same as that at 
Fry's in Los Angeles, then there's a $398 premium for the integration of 
DTT-reception circuitry.

- According to CEA, sales of DVD players to U.S. dealers for the first 
18 weeks of 2004 were up 1.9% over the same period in 2003. My ten-week 
running average was DOWN 7.9%. The glory days of double-digit growth 
seem gone forever.

- According to NPD Techworld, Cyberhome was the number-one brand of DVD 
player sold in March, followed by Sony, Toshiba, Samsung, and Apex. 
Those five brands accounted for more than half the sales to consumers at 
electronics/appliance stores, AV specialty stores, and mass merchants:
