Why. There was nothing for the Supreme Court to review, as the FCC reversed the
decision that the appeals courts had supported.
If there is to be a review of the reversal by the Supreme Court, it must be
based on the current litigation, which NO COURT has ruled upon yet.
Even here, it is unlikely the Supreme Court would get involved unless a lower
court tries to block the FCC Net Neutrality order. Since the FCC can keep
flip-flopping on Net Neutrality as futre administrations change, it is likely
the Supreme Court would uphold any FCC decision, perhaps suggesting that the
only way to resolve this issue is for Congress to do its job and legislate a
solution.
So, if the Supreme Court won't rehash the 2015 (belated) decision, what on
earth gives this rogue FCC the right to turn it all upside down? Rogue
indeed. Boot the scoundrels out of office!
Elections have consequences Bert. The current FCC has every right to do what
they did.
It’s time for Congress to deal with this.
There is a simple solution - Time to shut down the FCC as it plays no
meaningful role in modern telecommunications and spectrum policy.
