Happy New Year.

The court denied the motions to reconsider and set a schedule for a motion to
approve the class notice and a trial not before 90 days after approval of the
class notice.   A hearing on the class notice has not been set, but we expect
it to be heard soon and ruled on in the next 60 days.  That would probably
place the trial date after May 1, but we will keep you updated.

Isaac,

I know you and Ford have discussed this matter by phone as we have worked
toward a resolution and possible trial, but I wanted to give you a quick update.

The court denied both sides motions for summary judgment and granted a limited
class of owners in the Woodington I and II neighborhoods only.  As is
customary, both sides sought reconsideration of the orders.  We sought
reconsideration of the order denying summary judgment and reconsideration of
granting class certification to any owners or neighborhoods.  The Davis’ sought
reconsideration of the order limiting the class to Woodington I and II and
seeks certification for all neighborhoods.  The court required certain actions
through the end of the year and the Davis’ filed for approval of the class for
the owners in Woodington I and II.  We have reserved our rights to oppose the
motion pending the outcome of the motions to reconsider.

All of this update is along way of saying that the case is dormant again as we
wait on rulings from the court.  As soon as we receive any rulings on the
motions to reconsider and better direction from the court, we will provide you
another update.  In the meantime, please let me or Ford know if you have any
questions.
