We don't use a formal contract, but we do make this point clear to our 
students from the beginning.  At the end of tenth grade, I have the class 
take a diagnostic exam, and anyone whose grades are problematic is moved to 
the lower group for the next year, as it is less traumatic to the student. 
If a problem develops in the eleventh grade, I think it's important to catch 
the problem earlier in the year and either get extra help for the student or 
have him move to another group at that point, rather than wait until you 
have a formal magen score prepared.
