I think that the courts still consider the Constitution, specifically the
interstate commerce clause bit, to be valid.

I’m not generally a supporter of Federal authority over the states, but this is
the reason that the Constitution gives the Federal government authority over
inter-state commerce. Another example used during the hearing last month is
cellular data - radio emissions do not stop at State lines...
