That's not the way the courts have seen it to date.

They are selling an antenna service that receives the channel you request and 
delivers the bits to YOU via the Internet. 

Clearly this is unauthorized by the broadcasters, but it is less clear that 
there is a copyright violation. 

For some reason the media conglomerates have no problem with MVPDs making 
content you are paying for available via the Internet. 

Looks like the age old practice of trying to stop a leak in the proverbial 
dike. But the pressure is building for the dike to burst.
