By the FCC? Only if there was some fundamental flaw in the transmission

I do not agree at all that the lip-sync issue is purely a receiver problem. I know chief engineers at the network level who fight the lip-sync issue in the process of transmitting a proper signal. Sports remotes for example.

Surely laws have been broken by this and those both responsible
and irresponsible should be brought to justice.

What laws have been broken? The laws that forbid CE manufacturers from
designing less than perfect products?

YES.
Are digital TV receivers, dvd recorders with ATSC tuners and digital set top converter boxes no longer required to meet minimum performance FCC requirements?

Every single ATSC device I own that receives a digital TV signal has an FCC ID number on the model label. Isn't this a performance guarantee that the receiver will properly receive an ATSC signal?
