Because it was and is deemed an important medium for
the distribution of news and information, which are an
essential part of running a decent democracy with at
least a half-way informed electorate.

Congress could change this if there was a reason to.
Unless there's a public outcry to change this policy,
it is what it is.

In any event, some agency to control the use of
spectrum, in such a way as to avoid interference,
accidental or intentional, would be required
regardless. Even if this agency does nothing more
than stipulate that every transmitter must be agile,
and then accommodate the consequences of such a
decision.
