When the ATSC adopted E-VSB as part of A/53E, they included poison-pill
non-technical restrictions such as:

5.6.1 Enhanced Stream Rate Limits
Limits have been defined for the maximum bitrate in the Enhanced (E-VSB)
service. At all times, the quality of video in the main stream shall be
equal to or better than the equivalent program in the Enhanced stream. In
the event that the programming is different in the main and Enhanced
streams, a higher resolution format is deemed to be higher quality.
Additionally, during premium programming times, the maximum bitrate in the
enhanced (EVSB) stream shall be 3 Mbps out of the total 19.4 Mbps channel
capacity.

Hopefully the ATSC won't include similar poison pill requirements to the
A-VSB standard that will prevent it from being used in a practical business
model.

You have made the case very well. We at Sinclair could not justify any
serious "new" business model basedon the early 8VSB peformance. Now there
is
AVSB on the horizon. Even with the large bit penalty of AVSB we may have
something to work with. Isn't ironic that the small bit loss that was
alledged for COFDM in 1999 and was used to kill COFDM seems trivial today
with AVSB and how "amazed" people are that a portable or mobile system is
possible with 8VSB.
